A Prayer for My Son

Build me a son, o' Lord
Who will be strong enough to know when he is weak
And brave enough to face himself when he is afraid

Here let him learn compassion for those who fail
Build me a son whose heart will be clear, whose goals will be high

First time I heard this beautifully poetic written poem read was in my English class and I have fallen in love with it all of the sudden.
However, for me,  the last sentence should I say, "Then I, his mother"

The Deviation of Public Servant of Security

The definition of law in Indonesia actually have certain meaning which is not be able to explain each aspects . Even when I was kid and often heard about law , actually I should have hard to thinking or exact my mind to give definition about “ what is the meaning of law ? “ . No doubt , I will have a thought between justice and legal system . It's possibly not really same with the definition about law itself . I also believe that the law is belong to people who have the power or authority . Proper to my mindset about the subject who hold the law , Because I often saw that a police catch a stolen instead used a weapon during the process . So that , I have a mindset that a law as a punishment or sentence for a suspect . In a row to run the times , surely we should have different an idea to reach what is the law as widen . Nowadays , I have an idea that a law also be able to get an idea from the kid's idea . Because in nowadays , the law just be possed by a people who have the authority or power . Beside responsibility the servant to give service for the people who need a law and secure involve Indonesia as a Law Country . In reality there are many topics that take up in general society about the deviation of police . Althought , They are can be called “ Public Servant “ . Certainly I have many reason to reinforce my idea about the subject of law whose couldn't called a “ Public Servant “ .
To support my opinion , I taken the story from “ Anne Ahira “https://www.facebook.com/Anne.Ahira.Asian.Brain which one she said that she witness a violence of acts by police to her husband . In that stories explain that Anne's husband asked to a people to extinguish his smoke because he had an illness which couldn't to breath as well that he couldn't inhale a smoke surely . Supposed will get a good respon from that man , obvious what ? he got a bad response from him . The smoking man obviously a police but his manner didn't like a police because his conduct to deal with other people not drawing a good manner as the policeman . He also spoke rude with kick up Anne husband's feet . So sad , rights ? When we know about the behaviour of police who almost get bad values in public society . Actually , there are many cases that doing by police in Indonesia which make a bad perspective for others .

Just reminds about the police's cases who used their weapon to make a people keep silent even show their authority . As we know that a police couldn't to use a weapon without permitted or free will also a police should to throught certain procedure to get a permitted take a weapon . Based on the information from Indonesia Police Watch ( IPW ) which explains about the police cases where mostly the police doing a mistake to shot up their suspect in 2012 year in Indonesia from Aceh till Papua . There are 37 cases that explain about “ wrong target “ by police which is used their authority arbitrary . Cause regarding the cases which is done by police almost have related with “ vested interest of police “ where as they wanna get more respect from the others or exactly have a Cowboy Soul in they are . Moreover there is a police who get a drunk and not aware till cast loose a bullet to a man . Thus , The paradigm of police is almost bad although just certain police who to do that . Absolutely , it will enclosed the possibility to get a good perspective from the others eventhough they are make a change or a new recovery system for the process of .

for this section i would let to explain about inheritance in islamic law perspective and civil law.
the first explanation is what is the meaning of inheritance itself?Inheritance is something devolve in the form of property owned by a person after the testator dies or something given by devisor to heir.The inheritance must have been provided by the laws on who is entitled to inherit, how large or how many objects that will be inherited. now days so many case about heritage,this problem appear because one of the heirs were not satisfied with their part, because of that case indonesia government made a rules regarding inheritance.

 Inheritance law is set of  law governing what is going on to the assets of someone who has passed away, in other words, set the transition of wealth left by someone who had died and their consequences for heirs. Indonesia does not have a state inheritance laws but indonesia have three rules about inheritance they are customary law, civil law, and islamic law. There are some similarities and differences between the three legal principle governing the subject of inheritance.
  • In Islamic Law

In islamic laws set some rules of  law, according in islamic law the position of inheritance law include in family law. The laws about family law describe in quran verse An-Nissa(Q.S.IV) that means inheritance who left by devisor does not belonging all for heirs, but there is some part to paid devisor debt.
The factor to deserve inheritance are:
  1. the relation of blood such as father,mother,sister,and brother
  2. Marriage which is the legal ceremony (syar'i) between a man and a woman,if they are devorce the man and the women does not deserve anymore to get some of inheritance
  3. Al Wala is kindship because of legal,or the freedom of slave 
Factor for someone did not deserve the inheritance are:

1. Slave
Someone have status as a slave is not entitled to inherit even from his brother.Everything that owned by slaves, directly becoming owned the master. Slaves as qinnun (pure slave), mudabbar (slaves who have been declared free if his master dies), or mukatab (slave who had run exemption agreement with his master, the terms agreed by both parties). As a result, all kinds of slaves is thwart right to inherit and the right to inherit because they have no property rights. 
2. Murdered
If the heir killed the devisor then he is not entitled to inheritance. It is based on the words of the Prophet.:
"It is not right to inherit a killer who's killed."
3. different religious
As a muslim can not inherit or be inherited by non-Muslims, whatever their religion. It has affirmed the Prophet. in his saying:
 "It is not right to inherit a Muslim infidels, nor inherit Muslim infidels." (Bukhari and Muslim)
Amount of someone get inheritance based on Quran:
1.      Someone who deserve a half of inheritance are one from man and three from women
2.      Someone who deserve 1: 4 of inheritance are husband and wife
3.      Someone who deserve 1:8 is a wife
4.      Someone who deserve 2/3 are from women side such as two of daughter, two of granddaughter,etc
5.      Someone who deserve 1/3 they are the mother and the two of their sibling (the brother or the sister)
6.      Someone who deserve 1/6 such as the father,grandfather,mother,granddaughter (from man blood), sister(from father’s blood),grandmother,sister and brother(from mother’s blood).

According to the indonesia legal system there is many diversity of this case,it is because of each class of the population has the right to select the desired about the rule of law in accordance with their belief, customary or their group. as a heir we have many option to decided which system we would like to choose,there is islamic law and customary law. Each legal systems have difference principle, there are two authorities to decide in case of inheritance disputes, the authority of Islamic law is the Religious, and the authorized of customary law is the Court.
In indonesia legal system someone who deserve get the inheritance is:
·         Group I
In this group, the husband or wife or child and heir descendants are eligible to receive an inheritance. In the chart above that the inheritance is the wife / husband and three children. Each got a quarter part.
·         Group II
This group are those who get an inheritance if the heir does not have any husband or wife, and children. Thus the right are two parents, siblings, and relatives or descendants of the deceased.
In the example chart above who have inherited the father, mother, and two siblings heir. Each got a quarter part. In principle part of parents can not be less than ¼ section
·         Group III
In this group does not have any siblings so that getting a family inheritance in a straight line up, either from the mother or father
 Group IV
In this group are eligible to receive a family inheritance is blood in the line up are still alive. They got ½ parts. While the heir to the other line and rank closest to the deceased get ½ the remaining sections.


SIMILARITIES AND DIFFERENCES WITH NATIONAL LAW INHERITANC INHERITANC ISLAMIC LAW
Ø  Similarities
1.      Any inheritance will move from the hands of those who left a legacy to all heirs.
2.      In the case of funeral expenses, there is no difference between Islam and national laws of inheritance, meaning that in both system the first aim of the inheritance is used to pay for funeral expenses corpse.
3.      Subject for the same laws are among the Heir and his heirs.
4.      Elements of the same inheritance, every individu has freedom to make heritage statement.
5.      Those entitled heir is basically the same, the blood relatives of the Heir.
Ø  Differences
1.      In islamic men get more than a women,in civil law men and women equal
2.      In islamic law there is a separation between inheritance and the debt,like when you have debt to someone your heritage must be paid for debt first and then given to each heir

International Program Faculty of Law Universitas Islam Indonesia is a special undergraduate program (S1) which was first established in Daerah Istimewa Yogyakarta and Central Java Indonesia since the year of  2000/2001. Faculty of Law, Islamic University of Indonesia have specific concentration on International Law and Business Law. This program is conducted facilities by English Regular communication in, teaching learning processes, lectures, discussions, assignments, consultations, thesis writing and all other academic activities based on the reality. The reason why the faculty of Law offers International Programs is basically that globalization era and International networks have brought legal problems.This includes International transactions in trade and business as well as cyber law, and international dispute resolutions that have led the faculty of Law to challenge this international market demand.

Main Objectives


First, to support the dream of UII in achieving its visions as Islamic University with International qualification and enable UII to the world atmosphere of God's blessing of rahmatan lil 'alamin.

Second, to develop and propagate innovative, creative, and sensitive intellectual who is capable of competing in the global challenge, embodied with full commitment to the truth and justice, high morality and professionalism with reference to the university of the Islamic teaching.Third, to provide human resources of law graduates with high and international qualification so that could compete to gain more profit from the globalization era.Fourth, to customize students in certain law education processes with a broad understanding and comparative analysis so law graduates are expected to be ready to respond global market.Fifth, to prepare students with ability to think and express legal ideas and concepts in English so that they could become law graduates who could contribute to shape the shape the progressive legal development national and International job scopes.

 

Curriculum & its Advantages


The curriculum of the international program, in certain degree, is similar to the curriculum of regular program. In respect to the global demand, however, international program will emphasize its curriculum in Islamic law, national and international laws (Public and private), and comparative law. This combined curriculum will effect law student to gain certain advantages.First, Student will be more familiar with acquiring legal cases being solved.Second, International Programs will produce law graduates who become legal professional and expert in the field. Finally. They could compete to take an opportunity in occupying job positions in government and non-government employment both in Indonesia and in overseas.

 

Duration of Study


Students are required to complete 154 credit units to get LLB (Bachelor of Law, S1). They are also obliged to conduct research (library or filed research) and must demonstrate their research findings in a final examination of thesis (pendadaran). The whole programs will take place 7 semesters and no more than 14 semesters (7 years).

 

Vision and Mission


To be an excellent Islamic University in the world, it can inevitably be avoided that high quality of teaching and learning process in law is facilitated in English. Creative and innovative research program and Islamic propagation (dakwah)  are overwhelming effort to respond the necessary action for the entirely world hopes. This vision can be achieved by the following steps.The first is to foster education law which is not only facilitated in English, but also how to teach and assess students in more democratic and accountable ways. The second is to provide high quality staff who are academically considered as competent persons to deliver lecturers, workshop and other academic-activities. The third is to provide students with facilities which enable them to to solve the problems of their study.

 

Commencement


The International Class Program will commence on July this year, the 2013/2014 academic year. This will accommodate 40 students for one class or maximum two classes for 80 students.

 

Admission Requirements


Show High School certificate (STTB) or an equivalent status. A copy of High School certificate should be legalized by headmaster or Department of Education and transcript of academic progress. Have student Visa for those who are from overseas. Students can only be granted a Bachelor of Law if they reach 550 TOEFL score at the end of the study. An application form can be obtained from BUKOPIN Bank.Hand over three passport photographs scale 6 x 4 cm2

 

Procedure

1.  Fill in admission form of the UPCM and return it to the University Central Committee (for more       detailed procedure, see the UPCM manual).

2.  Candidates have to attach TOEFL score which can be obtained at :

-   CILACS (Center for International Language and Cultural Studies), Jl. Pattimura no.7 Kotabaru, or

-   The International Program Faculty of Economics, or

-   Language Center of Gadjah Mada University, or

-   Language Center of Universitas Negeri Yogyakarta, or

-   Extention Course of Sanata Dharma University, or IIEF

3. Students have to pay registration Fee of Rp. 165.000,- (for students who take TOEFL Test) or Rp.125.000,- (for Students who don't take TOEFL Test)
